Terms and conditions

GENERAL TERMS

EarMaster provides a personal subscription service limited to one person’s usage on their own personal devices. Sharing or transferring access to other individuals or devices is prohibited.

An EarMaster subscription allows one users to use EarMaster applications for as long as their subscription is active.

An Internet connection is required to use and manage the software licensed on a subscription basis. Without an Internet connection, your license may be temporarily disabled until the software can connect to EarMaster’s servers.

Subscription pricing is subject to change. Pricing changes for your subscription plan will be communicated to you 30 days before taking effect via the email address used with your EarMaster Subscription user account. The new pricing will be applied to your subscription plan when the next billing period starts, after the new prices have taken effect.

EarMaster reserves the right to cancel a subscription if abuse is repeated after one initial written warning sent to the user.

These terms are subject to change. Any changes that may affect you will be communicated to you beforehand via the email address used with your EarMaster Subscription user account.

INTELLECTUAL PROPERTY RIGHTS

The EarMaster software, including all content, features, and functionality, is the exclusive property of EarMaster ApS and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You agree not to reverse-engineer, decompile, disassemble, modify, translate, or create derivative works based on the software. You may not redistribute, sell, lease, or sublicense the software to any third party.

DATA STORAGE

You retain ownership of any intellectual property rights that you have in your stored EarMaster files.

EarMaster cannot be held responsible for loss of data stored on its Cloud servers. It is therefore advised that users back up their files on personal storage solutions.

PRODUCT SUBSCRIPTION

Your subscription will start when EarMaster confirms your payment, and it will continue for the period specified by the plan you have selected when signing up (e.g. monthly, yearly, etc.). The subscription will be renewed automatically according to the plan you selected, on the calendar day on which you started it, or on the last day of the month if that calendar day doesn’t exist.

If the payment of a subscription period can’t be completed on the scheduled day, EarMaster’s payment system will attempt to process the payment again the following days until the payment succeeds, or until the subscription is canceled by the customer.

CANCELLATION AND REFUND POLICY

You may stop your subscription at any time, thereby canceling the auto-renewal of your subscription starting from the end of the running billing period. Cancellation is done by you from your personal account dashboard at https://cloud.earmaster.com

Being an intangible service, EarMaster Subscriptions are non-returnable and non-refundable.

RESPONSABILITY OF THE CUSTOMER

The customer must provide a valid payment card which can be used to debit the amount due for the subscription period.

The customer understands that access to the internet at least once every 7 days is necessary to make use of the subscription.

Any unauthorized use of content that may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes are the sole responsibility of the customer.

INVOICING

Invoices are issued for each billing period, and available to the user from the account dashboard.

RENEWAL AND DELETION OF PAYMENT CARDS

Payment cards used for the subscription can be added or deleted by the user from the account dashboard.

FORCE MAJEURE

EarMaster shall not be liable for any failure or delay in performing its obligations under these terms if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, labor disputes, or internet outages. In such cases, EarMaster will use reasonable efforts to resume normal service as soon as possible.

GOVERNING LAW AND JURISDICTION

These terms and conditions shall be governed by and construed in accordance with the laws of Denmark. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Denmark.
